Insurance Litigation

Solve disagreements between policyholders and insurers over coverage, claim handling, and interpretation of policy terms.

Insurance Coverage & Litigation

Insurance policies are contracts that define the rights and obligations of both the insurer and the policyholder. Disputes often arise when an insurance company denies coverage, underpays a claim, or delays payment of benefits owed under the policy.

Harold B. Klite Truppman represents policyholders and businesses in insurance coverage disputes throughout South Florida, including Miami-Dade, Broward, and Palm Beach counties.

Insurance litigation frequently involves:

  • Denial or underpayment of insurance claims
  • Disputes regarding the interpretation of policy language
  • Failure to properly investigate or adjust claims
  • Disputes regarding scope of damage or causation
  • Failure to defend or indemnify insured parties
  • Commercial and residential property damage claims

Many insurance disputes arise after property losses involving hurricanes, water damage, fire, construction defects, or other casualty events.

Challenging an Insurance Claim Denial

Florida policyholders have the right to challenge an insurer’s denial or underpayment of a claim. Disputes may arise when an insurance company delays the handling of a claim, disputes the cause of damage, or pays less than the amount necessary to repair the property.

How Long Does an Insurance Company Have to Pay a Claim?

Florida law requires insurers to acknowledge and investigate claims promptly. In many situations, insurers must pay or deny a residential property claim within the statutory time period after receiving notice of the claim unless factors beyond the insurer’s control prevent payment. Interest may be owed on certain late payments.

Attorney’s Fees and Insurance Litigation

Florida law provides remedies in certain situations where an insurer fails to comply with its contractual or statutory obligations. In appropriate cases, policyholders who prevail in litigation may recover damages, costs, and attorney’s fees depending on the policy, the date of loss, and the applicable statutory framework.

You have the right to any and all benefits specified in your policy and do not have to settle for a denial or underpaid claim. If you have become involved in an insurance dispute, please call 800-511-7544.
